3. Collection and Processing of Data (Clarity Check)
When you use our "Clarity Check", we collect the information you enter about your business, together with your name, position, company name and email address.
Purpose of processing: To prepare and send your individual PDF report and to prepare for a possible orientation call.
Legal basis: Processing is based on Art. 6(1)(b) GDPR (steps taken at your request prior to entering into a contract) and on our legitimate interest in offering you a well-founded assessment of your situation (Art. 6(1)(f) GDPR).
Retention: Your answers and the result are kept in an internal record for as long as necessary to handle your request and any follow-up contact. They are then deleted, or earlier if you object. Working copies created to produce your report are deleted immediately after it has been sent.
Transparency notice on the use of artificial intelligence (EU AI Act): The text of your report is written by an AI system (a large language model) based on your answers. The traffic-light rating itself follows fixed, rule-based criteria. This does not constitute automated individual decision-making within the meaning of Art. 22 GDPR – the result is intended solely for your own orientation.
4. Hosting, Service Providers and Technical Infrastructure
Website & email: This website and our email service (Hostinger Mail) are operated by Hostinger on servers within the European Union (EU).
Automation engine (n8n): Your answers are processed and report generation is controlled by our own n8n instance on a Hostinger server in Frankfurt am Main, Germany.
AI analysis (Anthropic): To write your report, we send your answers and your company name to the programming interface of the Claude AI model provided by Anthropic PBC (USA). Your name and email address are not transmitted. Anthropic processes this data on our behalf and does not use it to train its models.
Report generation and storage (Google): The PDF report is generated from a Google Docs template, and your answers are stored in a Google spreadsheet. The provider is Google Ireland Limited, Dublin.
Transfers to third countries: Where data is transferred to countries outside the European Economic Area (in particular the USA), this is based on the EU-U.S. Data Privacy Framework or on EU Standard Contractual Clauses (Art. 46 GDPR), which ensure an adequate level of data protection.
5. Your Rights
You have the right at any time to receive information free of charge about the origin, recipient, and purpose of your stored personal data. You also have the right to request the rectification, restriction, or erasure of this data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority (Data Protection Commission, Ireland).
